Introduction

This privacy notice informs you about how your personal data is collected, stored and processed when you use counselling and psychotherapy services provided by Sara Faragher.

Under the UK GDPR, I process your data using the following legal grounds:

  • Contract: to deliver the counselling and psychotherapy services you request.
  • Legal obligation: to comply with statutory or regulatory duties.
  • Legitimate interests: where necessary for the running and security of the practice, provided this does not override your rights.
  • Consent: where required, for example for non-essential cookies or optional contact preferences.
  • Special category data condition: processing health data requires an additional condition under Article 9. I process this under Article 9(2)(h), which covers the provision of health or social care or treatment, subject to professional confidentiality safeguards.

Data Retention

Clinical notes and session records are retained securely for seven years following the conclusion of your therapy, unless a longer or shorter period is required by law, professional indemnity insurance or legal limitation periods. After this time, all digital and paper records are securely destroyed.

Data Sharing and Third Parties

Your data is kept strictly confidential. It is only shared with third-party data processors who provide essential business services, such as secure email hosting, booking software, website hosting, analytics tools where enabled, or payment processors. I will never sell your data. Exceptional circumstances where data may be shared without consent include a legal obligation, court order or legal subpoena, or if there is a serious risk of harm to yourself or others.

Your Rights

You have the right to access your data, request rectification, object to processing, restrict processing in some cases, request erasure in some cases, request data portability where applicable and withdraw consent where consent is the lawful basis. Please contact me directly to exercise these rights.

Complaints Procedure

If you believe your data protection rights have been breached, please contact me immediately at info@sarafaragher.co.uk.

  • Acknowledgement: I will acknowledge your complaint within 30 days of receipt.
  • Investigation: I will take appropriate steps to investigate and respond without undue delay, and I will keep you informed of progress.
  • Escalation: You have the right to lodge a complaint directly with the Information Commissioner’s Office (ICO) via their website at https://ico.org.uk or by calling 0303 123 1113.
